Title: 14. APPROVE AMENDED INTERLOCAL AGREEMENT FOR PUBLIC SCHOOL FACILITY PLANNING

Requested Action:
THAT THE DUVAL COUNTY SCHOOL BOARD APPROVE THE AMENDED INTERLOCAL AGREEMENT FOR PUBLIC SCHOOL FACILITY PLANNING AS SET FORTH IN THE ATTACHMENT TO THIS ITEM.

Summary Explanation and Background:

In the 2005 legislative session, Senate Bill 360 passed amending the Comprehensive Growth Management Act of 1985 and related laws regulating how local governments provide for public transportation, water management, and public school facilities.

The amendment requires a public school facilities element in local government comprehensive plans, establishes the requirement for school concurrency statewide and amended Interlocal Agreements, pursuant to Florida Statute 163.3180(13), 1013.33 and 163.31777.   With the enactment of Senate Bill 360, each county and each municipality within the county (unless exempt or subject to waiver) must adopt a public school facilities element in its comprehensive plan by January 1, 2008.

Florida Statute 163.31777 requires each school district and local government to adopt intergovernmental agreements as part of their comprehensive plan stating the principles and guidelines and describing the processes for collaborative planning and decision making for compliance with Senate Bill 360.
