Title: 2. PURCHASE AND SALE AGREEMENT WITH THE CITY OF JACKSONVILLE FOR THE CITY’S NEW AQUATIC CENTER AT FIRST COAST HIGH SCHOOL NO. 265
Requested Action:
THAT THE DUVAL COUNTY SCHOOL BOARD APPROVE THE PURCHASE AND SALE AGREEMENT OF 2.75‑ACRES TO THE CITY OF JACKSONVILLE FOR THE CITY’S NEW AQUATIC CENTER AT FIRST COAST HIGH SCHOOL NO. 265.
THAT THE DUVAL COUNTY SCHOOL BOARD AUTHORIZE THE DIRECTOR OF REAL ESTATE OR THE DIRECTOR OF REAL PROPERTY TO MAKE NON‑SUBSTANTIVE, NON‑TECHNICAL, NON‑MATERIAL CHANGES TO THE AGREEMENT WITHOUT SEEKING ADDITIONAL BOARD ACTION.
THAT THE DUVAL COUNTY SCHOOL BOARD AUTHORIZE ITS CHAIRMAN AND THE SUPERINTENDENT OF SCHOOLS TO EXECUTE THIS DOCUMENT WHEN FORM APPROVED BY THE OFFICE OF GENERAL COUNSEL.
Summary Explanation and Background:
At the regular school board meeting on August 1, 2006, the Duval County School Board approved the donation of a 2.75‑acre site at First Coast High School No. 265 to the City of Jacksonville. The City of Jacksonville will be moving forward with the new aquatic center construction on this site.
At the regular school board meeting on November 6, 2007, the Duval County School Board granted an easement for access and an easement for drainage to the City of Jacksonville for this project, which will be executed and recorded subsequent to the deeding of the 2.75‑acre site to the City of Jacksonville. The Purchase and Sale Agreement has been prepared to delineate the conditions of the donation of the site to the City of Jacksonville. The following conditions will be a part of this transaction. The City of Jacksonville will:
1. Grant an easement back to the Duval County School Board for access and maintenance of the existing propane tank, which will remain on part of the 2.75 acre site.
2. Perform due diligence on the site.
3. Move and re-establish the drivers’ education portable classroom to a location on the school site as delineated by the Duval County School Board.
4. Construct the aquatic center within four years of receiving the deed to the property. If the aquatic center is not constructed on this site within the four‑year period, the property will revert back to the ownership of the Duval County School Board.
In lieu of compensation, the City will enter into a Joint Use Agreement with the City of Jacksonville to allow for the Duval County School Board’s use of the aquatic center. Similar agreements are already in place for seventeen other aquatic center sites.
The principal at First Coast High School No. 265 is aware of this project.
