Requested Action:
THAT THE DUVAL COUNTY SCHOOL BOARD AUTHORIZE THE OFFICE OF GENERAL COUNSEL TO TAKE ALL ACTIONS NECESSARY TO APPEAL THE FINAL ORDER OF THE STATE BOARD OF EDUCATION'S DENIAL OF THE DUVAL COUNTY SCHOOL BOARD'S EXCLUSIVE AUTHORITY TO AUTHORIZE CHARTER SCHOOLSL FROM JULY 1, 2007 THROUGH JUNE 30, 2008.
Summary Explanation and Background:
The School Board of Duval County, Florida filed a timely application with the State Board of Education to retain exclusive authority to authorize charter schools within its geographic boundaries from July 1, 2007 through June 30, 2008. In a Final Order dated November 2, 2007, the State Board of Education denied the Duval County School Board's application. It is requested that the Duval County School Board grant authority to the Office of General Counsel to appeal the Final Order and to participate as a party in any proceedings that may be instituted by the Florida School Boards Association or by other district school boards to challenge the constitutionality of Section 1002.335, Florida Statutes, which created the Florida Schools of Excellence Commission and the State's chartering process.
