Title: 15. EXPULSION OF STUDENT
Requested Action:
WAIVE THE FINAL ORDER OF EXPULSION OF E.D. FROM PROVIDENCE ADVANCED PLACEMENT/COLLEGE PREPARATORY SCHOOL AND ALLOW E.D. TO BE ENROLLED IN A SCHOOL IN THE DUVAL COUNTY SCHOOL DISTRICT PURSUANT TO SECTION 1006.07 (b) 3 FLORIDA STATUTE.
Summary Explanation and Background:
E.D., a 15-year-old, student was expelled from Providence Advanced Placement/College Preparatory School on May 8, 2003 for bringing marijuana on campus. The expulsion was for the remainder of the 2002-03 school year and all of the 2003-04 school year.
As a result of the marijuana possession, JSO was contacted and E.D. was arrested. Following the arrest, E. D. participated in the Juvenile Arbitration Program, where he was ordered to write an apology to his parents, write an essay, take a tour of the jail and submit to a drug evaluation at Gateway Community Services.
E. D. previously attended Duval County Public Schools from July 19, 1993 through August 22, 1995. Our records do not reflect a history of discipline referrals.
E.D.’s mother, is requesting permission to enroll E.D. in this school district. Section 1006.07 (b) 3 of the Florida Statutes gives the School Board the option of waiving the expulsion from the other district and enrolling the student or honoring the expulsion. In this school district, E.D.’s behavior would be classified as a Class III offense and would not result in expulsion. Based upon the compliance of E.D. and his parents with the court system, and his exemplary discipline record up until this incident, it is recommended that E.D. is granted permission to enroll in a Duval County Public School, as well as in the district’s Night-time Substance Prevention Program within the first 45 days of school. If E.D. is unable to successfully complete the substance abuse program, he would be referred to the Hearing Officer for consideration of placement in an Alternative School Program.
