ATTENDANCE AT THIS SPECIAL MEETING OF THE DUVAL COUNTY SCHOOL BOARD: All Board Members were present, with the exception of Board Member Kris Barnes. Ms. LaShanda Dawkins, Assistant General Counsel, was also present.

Call Meeting to Order

  1. CALL MEETING TO ORDER
    Minutes: The Chairman called the Special Board Meeting to order at 3:30 p.m.

  1. EXPULSION OF STUDENT - R. B.
    Minutes: Ms. Bea Lewis explained the incident regarding student R.B. This student was charged with Arson - 4.02 in the burning of two portables on the campus of Arlington Middle School on Sunday, October 17, 2004. He and two other males jumped the fence surrounding the portables and started the fire. The parents of the other two students involved chose to withdraw from the school system.

    The father of the student said that his son did not start the fire. The student also indicated that he did not start the fire.

    After discussion the Board directed that R.B. continue home instruction pending General Counsel providing a legal opinion on whether or not this incident was brought properly before the Board. This case was deferred until mid-January 2005, at the latest.

  2. EXPULSION OF STUDENT - J. B.
    Minutes: Ms. Bea Lewis, Hearing Officer, explained that J.B. was a Bishop Kenney student who had been expelled for possession of marijuana, and explained what the punishment would have been if J.B. was a student in our school system.

    The parents and student were asked if they would like to speak. J.B., the student, indicated that he had learned his lesson and would not be put in this situation again. The mother and father also spoke on behalf of their child.

    Staff recommended that J.B. be granted permission to enroll in the school system (Englewood High School), and that he attend the district's Night-time Substance Use Prevention Counseling Education Program. If J.B. is unable to successfully complete the program he would be referred to the Hearing Officer for consideration of placement in an Alternative School Program.

    Minutes: Ms. Bea Lewis, Hearing Officer, explained that J.K. was a Bishop Kenney student who had been expelled for possession of marijuana, and explained what the punishment would have been if J.K. was a student in our school system.

    The father and student were asked if they would like to speak. J.K., the student, and his father, spoke regarding the incident.

  4. EXPULSION OF STUDENT - K. M.
    Minutes: Ms. Bea Lewis, Hearing Officer, explained that K.M. was a Bishop Kenney student who had been expelled for possession of marijuana, and explained what the punishment would have been if K.M. was a student in our school system.

    The parents and student were asked if they would like to speak. K.M., the student, indicated that he was asked to hold the marijuana for a friend and that it was not his. K.M. indicated that he should not have done this and will never do this again, as he wants to join the military and does not want to mess up those plans. His mother and father also spoke on their son's behalf.

    Staff recommended that K.M. be granted permission to enroll in the school system (First Coast High School), and that he attend the district's Night-time Substance Use Prevention Counseling Education Program. If K.M. is unable to successfully complete the program he would be referred to the Hearing Officer for consideration of placement in an Alternative School Program.
