THIS IS A GRIEVANCE SUBCOMMITTEE MEETING OF THE DUVAL COUNTY SCHOOL BOARD. The meeting was held in the 3rd Floor Conference Room No. 307. Subcommittee members Martha Barrett and Nancy Broner were present. Subcommittee Chairman Brenda Priestly Jackson was absent due to illness.

  1. CALL GRIEVANCE SUBCOMMITTEE TO ORDER
    Minutes: Ms. Martha Barrett served as Chairman and called the Grievance Subcommittee to order at 1:05 p.m., and explained the ground rules.

  1. STEP III GRIEVANCE - PAULA BAUCOM - UOPD
    Minutes: This Grievance was settled prior to the Grievance Subcommittee Meeting.

  2. STEP III GRIEVANCE - PERSONAL LEAVE WITH PAY (TEACHER UNIT) - LEW WELGE
    Minutes: This grievance involves a Guidance Counselor at Kirby-Smith Middle School who requested personal leave for August 1-2, 2002, to attend a family reunion. These were pre-planning days prior to students reporting to school. The leave was denied by the Principal, citing hardship to the school as the reason for denial. His absence left the school with one Guidance Counselor and a new office clerk to handle the workload. The Grievant took leave without pay for these two days. The relief requested is withdrawal of the Leave Without Pay form and compensation for lost wages.

    Mr. David Hertz, General Counsel for Duval Teachers United, presented on behalf of the Grievant, and Mr. Dane Gilbert, Director of Staffing for Human Resource Services, presented on behalf of the administration. Each party had an opportunity for rebuttal.

    The Subcommittee asked questions and deliberated the grievance.

    "That the Duval County School Board deny the requested relief."

  3. STEP III GRIEVANCE - STUDENT ORIENTATIONS (TEACHER UNIT) - SHANNON RUSSELL, CRAIG NELSON, LARRY ANDE
    Minutes: This grievance involves several schools (Matthew Gilbert Middle, Highlands, Middle, Butler Middle, and Kernan Middle)and relates to a "Student Orientation" held on Saturday August 3, 2002. Highlands Middle has settled their grievance, and is not included in this proceeding. The Orientations are voluntary, however, the Grievants felt it was implied mandatory when told there were tie-ins to student orientation, invitations to parents and descriptions of events as professional responsibility. Relief sought is pay for the Grievants and some type of statement from the Superintendent or Chief of Staff in wiring to the schools that it is voluntary attendance. The administration asserts that these orientations have been held for many years and has always been voluntary.

    Mr. David Hertz, General Counsel for Duval Teachers United, presented on behalf of the Grievants. Mr. Dane Gilbert, Director of Staffing for Human Resource Services represented the school administration. Both parties had an opportunity for rebtuttal.

    Ms. Barrett moved, and Ms. Broner seconded, the following motion:

    "That a partial remedy be granted. The Duval County School Board denies the request for payment, however, we are directing that a memorandum of understanding be sent to schools and teachers stating that these orientations are voluntary for teachers and that it will not be held against them if they do not attend, or reflected in their yearly evaluations."

    Vote: Ayes - 2 Nays - 0

  4. STEP III GRIEVANCE - UOPD RESTRUCTURING
    Minutes: This Grievance relates to an administrative change in the probationary terms and conditions of promoted employees in the UOPD unit. The Union indicated that administration had brought a proposal to the table during negotiations to change certain classified position(s) to a 12 month probationary period rather than the current six (6) month probationary period, and allowing the effected employees to use their annual leave after six (6) months. The Union rejected this proposal. Afterwards, the administration implemented the 12 month probationary period. The relief requested is that the administration's actions be reversed and the six (6) month probationary period be reinstated and that any employees that would have been permanent be made permanet.
